General terms and conditions of sale

These Terms apply to all sales of products made to you, the customer, via www.dior.com (the “Website”). Please read these Terms carefully before submitting your order to us. These Terms tell you who we are, how we will provide products to you, how you and we may change or end the contract, what to do if there is a problem and other important information.
By placing an order with us, you confirm that you agree to these Terms. If you do not agree to the Terms, please do not place any orders through the Website.
We reserve the right to make changes to these Terms at any time, without prior notice, and the new version of the Terms will apply to any offer or order placed on the Website after the new version has been posted. We therefore advise you to make sure that the Terms are suitable for you each time you place an order. The Terms are printable. Furthermore, a pdf version of the effective Terms will be attached to our order confirmation email.
1. Information about us and how to contact us
We are Parfums Christian Dior, société anonyme, with a capital of Euro 2 620 860, registered at the companies register of Paris (FRANCE) under the number 552 065 187, with our registered office is at 33 avenue Hoche, 75008 Paris, FRANCE, (hereinafter referred to as “PCD”).
For your information, PCD commits to comply with the principles set out in the LVMH Code of Conduct accessible and downloadable here https://www.lvmh.com/news-documents/lvmh-code-of-conduct/ . This Code of conduct provides an ethical framework for all its actions.

If we have to contact you, we will do so by telephone or by writing to you at the email address or postal address you provided to us in your order or in the “contact us”questionnaire.
We propose through our Website a specific secure remote ordering and remote payment service (the "Remote ordering and payment service") available from the Customer Service, for the Products offered on the Website.
2. Our products
The products offered for sale are the ones displayed on the Website on the day you consult the Website, subject to available stocks. The images of the products on our Website are for illustrative purposes only and although every effort is made to display colours accurately, we cannot guarantee that a device's display of the colours accurately reflects the colour of the products. Your products may vary slightly from those images.
3. Our contract with you
3.1. Orders
To place an order on the Website, you have to be an individual, a non-trade customer, aged of at least 18 and with full legal capacity.
In order to place an order, you have to:
If you wish to place an order, you have to select the products and the quantity of products that you wish to order and add them in your basket by clicking on the button “SHOP”. Please note that you can consult the summary of your order at anytime by clicking on the icon of your basket and/or during the check out process. After having filled your basket, you are invited to click on the button "PROCEED TO CHECK OUT" and provide your e-mail address, the billing address, the desired delivery address and the information relating to the chosen method of delivery, the amount of any delivery charges being specified at this stage.
You can also contact the Customer Service to benefit from the Remote ordering and payment service. In this case, you have to indicate to the Customer Service the products available on the Website and the quantity that you wish to order. The products are added to the basket by the Customer Service. Once the basket is filled, the Customer Service finalizes your order according to your choices and indications (choice of samples, packaging personalization option, verification of your delivery address and any information required to complete your order).

Our acceptance of your order will take place only when we send you an order confirmation email at the email address provided by you and you accept by placing an order the use of email to receive our confirmation of your order. At this point, a contract for the sale and purchase of the ordered products will come into existence between you and us. Theconfirmation email will show all details of products purchased, delivery addresses, billing address, delivery option, delivery costs, your unique reference number, the total sum deducted from your credit or debit card account, packaging options and will contain a pdf version of the effective Terms. We recommend that you keep this email for your records.
Please note that the contract is set out in the language of the order (i.e. English).
It will be archived for a period not exceeding the period required to fulfil the purposes for which it was archived.
If you have any questions about an order, please contact our Customer Service using the contact details in article 1. It will help us if you can tell us the order number whenever you contact us about your order.
If we are unable to accept your order we will inform you of this by email and will not charge you for the products. This might be because:

3.2. Price and Payment
The price of the products (which includes VAT) is displayed throughout your online journey, either visible in the basket on the top banner of the website or on the checkout pages when you place an order. To the extent permitted by law, if there is a change in the rate of VAT between your order date and the date we supply the products, we will adjust the rate of VAT that you pay, unless you have already paid for the products in full before the change took effect.
We take all reasonable care to ensure that the price of the products advised to you is correct but in the unlikely event that the products are incorrectly priced, we will contact you for your instructions before we accept your order. If we accept and process your order where a pricing error is obvious and unmistakeable and could reasonably have been recognised by you as a mispricing, we may end the contract, refund you any sums you have paid and require the return of any products provided to you.

For payment of orders placed through the Remote ordering and payment service, you can only use these debit/credit cards. You have to enter your card number, its expiry date and the visual cryptogram into the secure payment system via a link you receive by e-mail to the address provided by you.
WE'RE SORRY, WE DO NOT ACCEPT ANY OTHER TYPES OF PAYMENT.
We are sorry, but at this time, we do not offer gift certificates or gift cards.
We will charge your credit or debit card at the time of dispatch of the order.
Please be informed that you shall bear all compulsory taxes, fees, bank charges if any.
Secure payment is made through a service provider: PSP Cybersource which complies with security standards.
IMPORTANT INFORMATION:
For your security and to avoid any fraudulent transactions, your billing name and address must match that of the credit card used for payment. We reserve the right to cancel any order that does not match these criteria.
3.3. Maximum Purchase Policy
Products are sold on a retail basis to individuals for personal use only. As a result, for the purpose of protecting PCD's brand image and distribution system, we limit any orders to no more than five (5) units of any item per order.
In any case, you declare that you are acting as a consumer and that you exclude any intention of direct or indirect resale of one or several products for commercial purposes.
3.4. Order Cancellations
Occasionally, orders or parts of an order are cancelled by our system for various reasons. Some reasons are:
If your order is cancelled by us, you will receive an email from us. Your original payment method will be refunded for the appropriate amount.
If you wish to change or cancel your order prior to dispatch please call our Customer Service(see contact details in article 1) with your order number, to discuss what practical options are available to you. Please note as we generally process orders very quickly and dispatch orders within 1-2 days therefore it may not be possible to prevent your order from being dispatched. In this instance, please return your order once received in accordance with our returns policy which is set out below and in our Customer Service and FAQs document.
4. Delivery
4.1. Standard Delivery
Delivery costs will be indicated to you before your validation of the order.
Delivery time and costs depend on the delivery method you have chosen when ordering.
We offer complimentary delivery if the total amount of your order is equal or superior to €50to the address specified by you in your order by PCD. Your order is usually delivered within 3 – 5 working days from the date your order is accepted by us. Working days are Monday through Friday excluding French and Belgian bank holidays.
Please allow two additional days for deliveries to rural areas.
We will do our best to deliver the products within the time period indicated to you by PCD and at the latest within thirty (30) days as from the acceptance of the order. In case of absence of delivery in the delay indicated, you shall contact in the best delay the Customer Service at the number and/or email address indicated in article 1. In this event, the Customer Service will propose a new delivery date or the cancellation of the order and its refund.
If our supply of the products is delayed by an event outside our control, we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this we will not be liable for delays caused by the event, but if there is a risk of substantial delay (i.e. more than thirty (30) days as from the acceptance of the order), you may contact us to end the contract and receive a refund, within fourteen (14) days of the termination of the contract, for any products you have paid for but not received.
All orders require a signature upon delivery. If you are not there to receive your order, the carrier will leave contact information, a delivery card for you or will contact you to make alternative arrangements.
If, after a failed delivery to you, you and the carrier do not re-arrange delivery/collectionwithin a reasonable delay, then, either the carrier or PCD will contact you for further instructions and may charge you for storage costs and any further delivery costs. If, despite reasonable efforts, we are unable to contact you or re-arrange delivery or collection we may end the contract and you may be liable to pay us compensation.
4.2. Delivery Addresses
Unless you tell us otherwise during the ordering process, we will deliver your purchased products to the delivery address you have provided in your account information.
We will take all reasonable care to deliver to the address given. However, we will not be liable for non-delivery or mis-delivery as a result of incorrect data entry by you.
We are sorry we only deliver online orders to Luxembourg addresses.
4.3 Ownership and Responsibility
Upon delivery you must check the conformity of the order with the carrier and issue all necessary reservations if any (apparent defects, damaged parcel, parcel open, etc.) on the delivery note as detailed as possible and refuse the parcel. In that case, you must also contact our Customer Service in the best delay and we will launch the appropriate inquiry.
You will be responsible for the products once they have been delivered to the address you have provided.
You own the products once we have received payment in full.
5. Your rights to end the contract
You may be entitled to end your contract with PCD and return the products, but your right to end the contract will depend on the products you have purchased, whether you have simply changed your mind, whether there is anything wrong with the products we have supplied, how we are performing and when you decide to end the contract.
If you want to end the contract because of something PCD has done or has told you PCD isgoing to do, see article 5.1.
If you want to exercise your right of withdrawal, see article 5.2. You may be able to get a refund if you meet the conditions indicated in article 5.2.
If what you have bought is faulty or misdescribed you may have a legal right to get the product repaired, replaced or to get some or all of your money back, see article 5.3.
5.1 Ending the contract because of something PCD has done or is going to do
If you are ending a contract for a reason set out below, the contract will end immediately and we will refund you in full, within fourteen (14) days of the termination, of the contract for any products which have not been provided. The reasons are:
5.2 Your right of withdrawal
Whilst PCD hopes that you are delighted with your order, if for any reason you are not entirely satisfied or you otherwise change your mind, as a consumer, you have a legal right of withdrawal as follows:
For reasons of hygiene and health protection, you do not have a right of withdrawal in respect of products where any seal or similar protection on those products has been broken or tampered with.
In addition, we inform you that you will not be able to exercise your right of withdrawal when purchasing products:
5.3 If there is a problem with the product
Please notify us immediately after delivery of any damage or incorrectly supplied products or if the products listed on the dispatch note do not match those contained in your delivery by contacting our Customer Service (see contact details in article 1) with your order details. To ensure prompt resolution, please provide the order number and the box, packing materials, all complimentary items (e.g. gift(s) with purchase, sample(s)) and the damaged items for inspection by the carrier.
Furthermore, all the products supplied by us benefit from the legal guarantee of conformityand from the legal warranty against hidden defects.
Legal guarantee of conformity
Articles L217-3 to L217-20 of the French consumer Code regulate the legal guarantee of conformity. We also inform you of the existence of statutory warranty of conformity of goods within your country of residence. Please find here below for your information the translation of some of the articles of the French consumer Code:
Article L217-3 of the French consumer Code: “The seller shall deliver goods that conform to the contract and to the criteria set forth in Article L. 217-5.
He is responsible for the defects of conformity existing at the time of the delivery of the good within the meaning of article L. 216-1, which appear within two years as from this one. (…)
The seller shall also be liable, during the same time period, for any lack of conformity resulting from the packaging, the assembly instructions or the installation when the latter was made his responsibility by the contract or was carried out under his responsibility, or when the incorrect installation, carried out by the consumer as provided for in the contract, is due to shortcomings or errors in the installation instructions provided by the seller.
This warranty period applies without prejudice to articles 2224 and following of the French Civil Code. The starting point of the limitation period for the consumer's action is the day on which the consumer becomes aware of the lack of conformity.”
Article L217-4 of the French consumer Code: “The goods conform to the contract if they meet the following criteria, where applicable
1° It corresponds to the description, type, quantity and quality, in particular as regards functionality, compatibility, interoperability, or any other characteristic provided for in the contract ;
2° It is fit for any special purpose sought by the consumer, made known to the seller at the latest at the time of the conclusion of the contract and accepted by the latter;
3° It is delivered with all the accessories and installation instructions to be provided in accordance with the contract;
4° It is updated in accordance with the contract.
Article L217-5 of the French consumer Code: “I. In addition to the criteria of conformity to the contract, the good is conforming if it meets the following criteria:
1° It is fit for the use normally expected of goods of the same type, taking into account, where applicable, any provisions of European Union law and national law as well as all technical standards or, in the absence of such technical standards, specific codes of conduct applicable to the sector concerned ;
2° Where applicable, it has the qualities that the seller has presented to the consumer in the form of a sample or model, before the conclusion of the contract;
3° Where applicable, the digital elements it contains are provided in the most recent version available at the time the contract is concluded, unless the parties agree otherwise;
4° Where applicable, it is delivered with all the accessories, including packaging, and installation instructions that the consumer can legitimately expect;
5° Where applicable, it is supplied with the updates that the consumer may legitimately expect, in accordance with the provisions of Article L. 217-19;
6° it corresponds to the quantity, quality and other characteristics, including durability, functionality, compatibility and safety, that the consumer can legitimately expect for goods of the same type, taking into account the nature of the goods as well as public statements made by the seller, by any person upstream in the chain of transactions, or by a person acting on their behalf, including in advertising or on the label.
1° that he did not know them and was not legitimately able to know them ;
2° that, at the time the contract was entered into, the public statements had been corrected in a manner comparable to the original statements; or
3° that the public statements could not have influenced the decision to purchase.
Article L217-7 of the French consumer Code: “Defects of conformity that appear within twenty-four months of delivery of the goods, including goods with digital elements, are, unless proven otherwise, presumed to have existed at the time of delivery, unless this presumption is incompatible with the nature of the goods or the defect claimed.(…)”
Article L217-8 of the French consumer Code: “In the event of a lack of conformity, the consumer has the right to have the goods repaired or replaced or, failing that, to have the price reduced or the contract rescinded, in accordance with the conditions set out in this sub-section. (…) The provisions of this chapter are without prejudice to the award of damages.”
Article L217-9 of the French consumer Code: “The consumer is entitled to demand that the goods comply with the criteria set out in sub-section 1 of this section. The consumer shall request the seller to bring the goods into conformity, choosing between repair and replacement. To this end, the consumer shall make the goods available to the seller.”
Article L217-10 of the French consumer Code: “The goods shall be brought into conformity within a reasonable time, which may not exceed thirty days following the consumer's request and without major inconvenience to the consumer, taking into account the nature of the goods and the use intended by the consumer. The repair or replacement of the non-conforming good includes, if necessary, the removal and return of the good and the installation of the repaired or replacement good by the seller. A decree specifies the terms and conditions for bringing the goods into conformity.”
Article L217-11 of the French consumer Code: “The goods are brought into conformity at no cost to the consumer. The consumer is not required to pay for the normal use he made of the replaced good during the period prior to its replacement.”
Article L217-12 of the French consumer Code: “The seller may not proceed according to the choice made by the consumer if the requested compliance is impossible or entails disproportionate costs with regard to, in particular:
1° The value that the goods would have if there was no lack of conformity;
2° the significance of the lack of conformity; and
3° the possibility of choosing the other option without major inconvenience to the consumer.
The seller may refuse to bring the goods into conformity if this is impossible or would entail disproportionate costs, particularly with regard to 1° and 2°.
When these conditions are not respected, the consumer can, after formal notice, pursue the forced execution in kind of the solution initially requested, in accordance with articles 1221 and following of the civil code.
Any refusal by the seller to proceed according to the consumer’s choice or to bring the goods into conformity shall be motivated in writing or on a durable medium.”
Article L217-13 of the French consumer Code: “Any good repaired under the legal guarantee of conformity benefits from a six-month extension of this guarantee. If the consumer chooses to have the goods repaired but the seller does not do so, the replacement of the goods to bring them into conformity will give rise to a new period of legal warranty of conformity for the replaced goods. This provision applies from the day the replacement goods are delivered to the consumer.”
Article L217-14 of the French consumer Code: “The consumer is entitled to a reduction in the price of the goods or to rescission of the contract in the following cases:
1° Where the seller refuses to bring the goods into conformity ;
2° If the goods are brought into conformity after a period of thirty days following the consumer’s request or if it causes him a major inconvenience;
3° If the consumer definitively bears the cost of taking back or removing the non-conforming goods, or if he bears the installation of the repaired or replacement goods or the related costs;
4° If the non-conformity of the goods persists despite the seller’s attempt to bring them into conformity, which has not been successful.
The consumer is also entitled to a reduction in the price of the goods or to rescission of the contract when the lack of conformity is so serious that it justifies the reduction in price or the rescission of the contract being immediate. The consumer is then not obliged to ask for the repair or replacement of the goods beforehand.
The consumer shall not be entitled to rescind the sale if the lack of conformity is minor, which the seller shall have the burden of proof. This paragraph shall not apply to contracts in which the consumer does not pay a price.”
Article L217-15 of the French consumer Code: “In the cases provided for in Article L. 217-14 of the French consumer Code, the consumer shall inform the seller of his decision to obtain a reduction in the price of the goods. The reduction in price is proportional to the difference between the value of the goods delivered and the value of the goods in the absence of the lack of conformity.”
Article L217-16 of the French consumer Code: “In the cases provided for in Article L. 217-14 of the French consumer Code, the consumer shall inform the seller of his decision to cancel the contract. He returns the goods to the seller at the latter’s expense. The seller shall reimburse the consumer the price paid and return any other benefit received under the contract (…)”
Article L217-17 of the French consumer Code: “The reimbursement to the consumer of the sums owed by the seller under this sub-section shall be made upon receipt of the goods or of the proof of their return by the consumer and at the latest within the following fourteen days. The seller shall reimburse these sums using the same means of payment as the one used by the consumer to conclude the contract, unless the latter expressly agrees and in any case without additional costs.”
Within the framework of the legal guarantee of conformity and to the extent permitted by law, provided that (i) your request meets the conditions for the guarantee to apply and (ii) you act within two (2) years from the delivery of the product, you may obtain: - repair or replacement of the product with an identical product (provided that such product is available in stock), at your option, unless one of these options entails a disproportionate cost for PCD compared to the other possible option, or - if repair and replacement of the product are not possible or cannot be implemented within thirty (30) days of your request or cause a major inconvenience to you, a full or partial refund of the price of the product, by crediting your bank account, no later than fourteen (14) days after PCD receives the returned product. Please note that you (i) are not required to prove the existence of a defect in the conformity of the product during the twenty-four (24) months following the delivery of the product and (ii) that the legal warranty of conformity applies independently of any commercial warranty that may have been granted. Finally, please note that you may decide to implement the legal warranty against hidden defects in accordance with the box below. |
Legal warranty against hidden defects
Articles 1641 to 1649 of the French civil Code regulate the legal warranty against hidden defects.
Please find here below for your information the translation of some of these articles:
Article 1641 of the French civil Code: “The seller is bound by the warranty for hidden defects of the good sold which render it unfit for the purpose for which it was intended, or which so diminish this use that the buyer would not have acquired it, or would have given only a lesser price, if he had known about them.”
Article 1644 of the French civil Code: “In the case of articles 1641 and 1643 of the French civil Code, the buyer has the choice of returning the thing and having the price returned to him, or keeping the thing and having part of the price returned to him.”
Article 1646 of the French civil Code: “If the seller was unaware of the defects of the thing, he shall be bound only to refund the price, and to reimburse the purchaser for the expenses incurred by the sale.”
Article 1648 of the French civil Code: “The action resulting from hidden defects must be brought by the buyer within two years from the discovery of the defect. (…)”
Within the framework of the legal guarantee of the hidden defects, when applicable, provided that you bring the proof of the existence of the hidden defect, you can obtain: - a refund of the price of the product if you return the product, or - a refund of part of the price of the product if you keep the product, excluding any compensation, by crediting your bank account, at the latest within fourteen (14) days from the recognition and acceptance by PCD of the hidden defect. |
If you wish to exercise your legal rights in the event of a non-conformity or hidden defect of the products under the relevant statutory warranties, please contact our Customer Service (see contact details at article 1) which will guide you regarding how to return products, and/or request a repair or a replacement or a refund of the product concerned.
6. How to make a return
Subject to article 6. b), if you are entitled to return products under article 5, you are entitled toreturn the products concerned and the associated complementary items associated if any (e.g. gift(s) with purchase, sample(s)) , free of charge, with the prepaid shipping label included in the parcel received. You must affix the prepaid shipping label to the returned parcel to drop it off at a post office or a collection point. Please contact our Customer Service using the contact details in article 1 to inform us about the return. Our Customer Service will guide you if needed regarding how to return products, and/or request a repair or a replacement or a refund of the product concerned.
Please note that if you make a return using a method other than the method proposed by us(e.g. prepaid shipping label), you will be responsible and will bear fully any applicable costs and charges involved for the return of the products.
Please ensure you obtain a proof of postage when you return the products and the complementary items associated if any (e.g. gift(s) with purchase, sample(s)) to us. You should retain your proof of postage in order to provide proof to us that you have returned the products and all complimentary items (e.g. gift(s) with purchase, sample(s)), in the unlikely event that we do not receive the returned parcel.
Within the order packaging, you will find a “Return Form” with details of your order together with details of our returns process.
a) Returning Products
Products and all complimentary items (e.g. gift(s) with purchase, sample(s)) must be returned to us promptly at our distribution centre at the address provided by our Customer Service or within the “Return form” in the order packing.
In any case, please ensure that the returned parcel is properly sealed and that you obtain a proof of postage.
b) Return procedure concerning article 5.2 (withdrawal right)
Notwithstanding the foregoing, if you are entitled to return products under article 5.2, all you have to do is send us the products concerned accompanied by the completed model of “Return form” provided by us in the parcel or as proposed in Appendix 1 or any other unambiguous written statement expressing your decision to exercise your right of withdrawal, and return the products and all complimentary items (e.g. gift(s) with purchase, sample(s)) to us to receive a refund.
Please attach the pre-filled and prepaid transport label, which has been sent to you by any appropriate mean (including but not limited to: e-mail, return form attached to the package, etc.), to your package before dropping it off at a post office. The return address shall appear on any prepaid transport label as follows: Customer Returns Service Dior.com, 185 Avenue de Verdun 45804 Saint Jean de Braye Cedex, France.
Please note that if you make a return using a method other than the one proposed in this article and you have exercised your right of withdrawal (see article 5.2), you will be solely responsible and will bear fully any applicable costs and charges involved for the return of the products.
c) Processing the refund, replacement or repair
i) If you have returned products because you have exercised your right of withdrawal, we will process the calculated refund, by using the original method of payment, as soon as possible and in any event within fourteen (14) days after the day we receive the returned products or (if earlier) the day on which you provide us with evidence of having sent the products back to us at our distribution centre. We will not be obliged to make a refund if you cannot provide evidence that you have sent the products and all complimentary items (e.g. gift(s) with purchase, sample(s)) back to us so therefore please ensure that you retain, and are able to provide, proof of postage. Please note that a full refund will not be provided for returned products that show signs of unreasonable use.
ii) If you have returned products because they are damaged, or in the event of a non-conformity or defect under the relevant statutory warranty, and if you have required us to refund partially or in full the products, we will process your refund as soon as possible and in any event within fourteen (14) days after the day we receive your returned products and if we confirm that you are entitled to a refund.
Refund will only be made against the original credit/debit card used for the purchase. You will receive email notification of your refund from our Customer Service.
iii) If you have returned products because they are damaged, or in the event of a non-conformity or defect under the relevant statutory warranty, and if you have required us to repair or to replace the products, please note that we will proceed to the repair or the replacement if we confirm that you are entitled to it and provided that the option chosen by you is not impossible or disproportionate as determined by the applicable Law. Any refusal to proceed according to your choice or to bring the product into conformity will be motivated in writing or on a durable medium by our Customer Service.
If you have requested a replacement and if we accepted it, this will be processed within fourteen (14) working days of receiving your returned products and will be delivered via standard delivery. Deliveries of replacement products will be completed on the delivery terms set out above.
7. Our liability to you
If we fail to comply with these Terms or fail to use reasonable skill and care in relation to our arrangements with you, we are responsible to you for direct foreseeable loss and damage caused to you as a result. Loss or damage is foreseeable if it is oblivious it would happen or if, at the time the contract was made between us, both PCD and you knew it might happen.
We only supply the products to you for private use and not for commercial, business or resale purposes. We therefore will have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.
8. Data collected
Please see our Data Protection policy accessible here on the Website to understand how we will use, process and protect the personal information and the data submitted by you when creating an account, purchasing products and when you are otherwise using the Website.
We will use the data including personal information you provide to us:
(a) to supply the products to you;
(b) to process your payment for the products; and

9. Intellectual property
All intellectual property rights, whatever their nature, attached to all products sold on theWebsite and the elements appearing on the Website (including in particular: texts, logos, trademarks, graphics, images, photos, videos, animations, names and any other element) are and remain the exclusive property of PCD, and are exclusively reserved to it. 10. Other Important Terms

If we do not insist immediately that you do anything you are required to do under these Terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean a waiver of our rights or that you do not have to do those things and it will not prevent us taking steps against you at a later date.
These Terms are governed by French law subject to the mandatory rules of your country of residence and you can bring legal proceedings in respect of the products in the French courtssubject to the mandatory rules of your country of residence or settle the dispute through an alternative dispute resolution mechanism, as set out below.
Information on alternative dispute settlement: The EU Commission offers the possibility of online dispute resolution on an online platform operated by it. This platform can be accessed via the external link http://ec.europa.eu/consumers/odr/ . We are not obliged to participate in a conciliation procedure and unfortunately cannot offer participation in such a procedure.

For reasons of hygiene and health protection, you do not have a right of withdrawal in respect of products where any seal or similar protection on those products has been broken or tampered with.
In addition, we inform you that you will not be able to exercise your right of withdrawal when purchasing products:
Parfums Christian Dior will issue the refund by using the original method of payment as soon as possible or in any event fourteen (14) days upon the arrival of the returned products or upon the delivery of the proof of shipment of the products; the date chosen being that of the first of these facts, in accordance with applicable law.
We are not obliged to reimburse any additional delivery costs if you choose another delivery method than the prepaid label provided by us.

Bine ati venit la www.dior.com/en_ro . Prezenta sectiune a website-ului nostru stabilestetermenii si conditiile noastre generale de vanzare ("Termeni"), inclusiv procesul nostrucomplet de livrare si returnare.
Respectivii Termeni se aplica tuturor vanzarilor de produse efectuate catre dumneavoastra, clientul, prin intermediul www.dior.com/en_ro ("Website-ul"). Va rugam sa cititi cu atentieacesti Termeni inainte de a ne transmite comanda dumneavoastra. Acesti Termeni va spun cine suntem, cum va vom furniza produsele, cum putem modifica sau inceta contractul, cetrebuie sa faceti daca exista o problema si alte informatii importante.
Prin plasarea unei comenzi la noi, confirmati ca sunteti de acord cu acesti Termeni. Daca nu sunteti de acord cu Termenii, va rugam sa nu plasati nicio comanda prin intermediul Website-ului.
Ne rezervam dreptul de a face modificari la acesti Termeni in orice moment, iar noua versiunea Termenilor se va aplica oricarei oferte sau comenzi plasate pe Website dupa ce nouaversiune a fost publicata. Prin urmare, va sfatuim sa va asigurati ca sunteti de acord cu Termenii de fiecare data cand plasati o comanda. Termenii sunt imprimabili. 2. Produsele noastre

3. Contractul nostru cu dumneavoastra
3.1. Comenzi
Pentru a plasa o comanda pe Website, trebuie sa fiti o persoana fizica, un client necomercial, in varsta de cel putin 18 ani si cu capacitate juridica deplina de exercitiu.
Pentru a plasa o comanda, trebuie sa:
Daca doriti sa plasati o comanda, trebuie sa selectati produsele si cantitatea de produse pe care doriti sa le comandati si sa le adaugati in cosul dumneavoastra, facand clic pe butonul"CUMPARARE". Va rugam sa retineti ca puteti consulta oricand rezumatul comenzii dvs. facand clic pe pictograma cosului dvs. si/sau in timpul procesului de check-out. Dupa ce v-aticompletat cosul, sunteti invitat sa faceti clic pe butonul "FINALIZATI COMANDA" si safurnizati adresa de e-mail, adresa de facturare, adresa de livrare dorita si informatiilereferitoare la metoda de livrare aleasa, valoarea eventualelor taxe de livrare fiind precizata in aceasta etapa.

Pentru a va confirma si finaliza definitiv comanda, trebuie sa:
Acceptarea de catre noi a comenzii dumneavoastra va avea loc numai atunci cand va trimitemun e-mail de confirmare a comenzii la adresa de e-mail furnizata de dumneavoastra siacceptati, prin plasarea unei comenzi, utilizarea e-mailului pentru a primi confirmarea noastraa comenzii dumneavoastra. In acest moment, intre dumneavoastra si noi va exista un contractde vanzare a produselor comandate. E-mailul de confirmare va prezenta toate detaliile privindprodusele achizitionate, adresele de livrare, adresa de facturare, optiunea de livrare, costurilede livrare, numarul dumneavoastra unic de referinta, suma totala dedusa din contuldumneavoastra de card de credit sau de debit, optiunile de ambalare si va contine o versiunepdf. a Termenilor in vigoare. Va recomandam sa pastrati acest e-mail pentru registreledumneavoastra.
Va rugam sa tineti cont de faptul ca contractul este redactat in limba in care este redactatacomanda (si anume limba Engleza).
Va fi arhivat pentru o perioada care nu va depasi perioada necesara pentru a indepliniscopurile pentru care a fost arhivat.
In cazul in care aveti intrebari cu privire la o comanda, va rugam sa contactati Serviciul de Asisitenta Clienti folosind detaliile de contact de la articolul 1. Ne va fi de ajutor daca ne puteti spune numarul comenzii ori de cate ori ne contactati in legatura cu comandadumneavoastra.
In cazul in care nu va putem accepta comanda, va vom informa prin e-mail si nu va vomfactura produsele. Acest lucru se poate intampla in urmatoarele situatii:
Va rugam sa retineti ca nu putem procesa comenzi la o adresa a casutei postale.
3.2. Pretul si Plata
Pretul produselor (include TVA) este afisat pe tot parcursul calatoriei dumneavoastra online, fie ca este vizibil in cosul de pe bannerul de sus al website-ului, fie in paginile de plata atuncicand plasati o comanda. In masura in care acest lucru este permis de lege, in cazul in care exista o modificare a cotei de TVA intre data comenzii dvs. si data la care furnizam produsele, vom ajusta cota de TVA pe care o platiti, cu exceptia cazului in care ati platit deja produselein intregime inainte ca modificarea sa intre in vigoare.
Ne luam toate masurile rezonabile pentru a ne asigura ca pretul produselor care va estecomunicat este corect, dar in cazul putin probabil in care pretul produselor este incorect, vavom contacta pentru a va oferi instructiuni inainte de a va accepta comanda. In cazul in care acceptam si procesam comanda dumneavoastra in cazul in care eroarea de pret este evidentasi inconfundabila si ar fi putut fi recunoscuta in mod rezonabil de catre dumneavoastra ca fiindo stabilire gresita a pretului, putem anula contractul, va putem rambursa orice suma pe care atiplatit-o si va putem solicita returnarea oricaror produse care v-au fost furnizate.
Produsele vor fi platite in EURO.
Puteti plati produsele folosind urmatoarele optiuni de plata:
CARDURI DE CREDIT / DEBIT ACCEPTATE:
NE PARE RAU, NU ACCEPTAM ALTE TIPURI DE PLATA.
Ne pare rau, dar in acest moment, nu oferim certificate sau carduri cadou.
Va vom debita cardul de credit sau de debit in momentul expedierii comenzii.
Va rugam sa fiti informat ca veti suporta toate taxele obligatorii, comisioanele, taxele bancare, daca exista.
Plata securizata se face prin intermediul unui furnizor de servicii: PSP Cybersource care respecta standardele de securitate.
INFORMATIE IMPORTANTA:
Pentru securitatea dumneavoastra si pentru a evita orice tranzactie frauduloasa, numele siadresa de facturare trebuie sa corespunda cu cele ale cardului de credit utilizat pentru plata. Ne rezervam dreptul de a anula orice comanda care nu corespunde acestor criterii.
3.3. Politica de Achizitie Maxima
Produsele sunt vandute persoanelor fizice numai pentru uz personal. Prin
urmare, in scopulprotejarii imaginii de marca si a sistemului de distributie
al PCD, limitam comenzile la maximum cinci (5) unitati din orice produs pe
comanda.
In orice caz, declarati ca actionati in calitate de consumator si ca excludeti orice intentie de revanzare directa sau indirecta a unuia sau mai multor produse in scopuri comerciale.
3.4. Anulare de comenzi
Ocazional, comenzi sau parti ale unei comenzi sunt anulate de sistemul nostru din diverse motive. Motive sunt:
In cazul in care comanda dumneavoastra este anulata de catre noi, veti primi un e-mail din partea noastra. Metoda dumneavoastra de plata originala va fi rambursata pentru sumacorespunzatoare.
Daca doriti sa va modificati sau sa anulati comanda inainte de expediere, va rugam sa apelatiEchipa noastra de Asistenta Clienti (a se vedea detaliile de contact din articolul 1), mentionand numarul comenzii, pentru a discuta despre optiunile practice disponibile. Varugam sa retineti ca, in general, procesam comenzile foarte repede si le expediem in 1-2 zile, prin urmare, este posibil sa nu fie posibil sa impiedicam expedierea comenzii dumneavoastra. In acest caz, va rugam sa returnati comanda odata primita, in conformitate cu politica noastrade returnare, care este prezentata mai jos si in documentul nostru de Asistenta Clienti si in documentul FAQ.
4. Livrarea
4.1. Livrarea Standard
Costurile de livrare va vor fi indicate inainte de validarea comenzii.
Timpul si costurile de livrare depind de metoda de livrare pe care ati ales-o la comanda.
Oferim livrare gratuita daca valoarea totala a comenzii dvs. este egala sau superioara la 50 EUR la adresa specificata de dvs. in comanda dvs. prin PCD. Comanda dvs. este livrata, de obicei, in termen de 3 - 5 zile lucratoare de la data la care comanda dvs. este acceptata de noi. Zilele lucratoare sunt de Luni pana Vineri, cu exceptia sarbatorilor legale franceze si belgiene.
Va rugam sa acordati doua zile suplimentare pentru livrarile in zonele rurale.
Vom face tot posibilul pentru a va livra produsele in perioada de timp indicata de PCD si celtarziu in termen de treizeci (30) de zile de la acceptarea comenzii. In cazul in care nu se efectueaza livrarea in termenul indicat, veti contacta in cel mai scurt timp Serviciul de Asistenta Clienti la numarul si/sau adresa de e-mail indicate la articolul 1. In acest caz, Serviciul de Asistenta Clienti va propune o noua data de livrare sau anularea comenzii sirambursarea acesteia.
In cazul in care furnizarea produselor este intarziata din cauza unui eveniment care nu se aflasub controlul nostru, va vom contacta cat mai curand posibil pentru a va anunta si vom luamasuri pentru a minimiza efectul intarzierii. Cu conditia sa facem acest lucru, nu vom fi raspunzatori pentru intarzierile cauzate de eveniment, dar daca exista riscul unei intarzierisubstantiale (adica mai mult de treizeci (30) de zile de la acceptarea comenzii), ne puteticontacta pentru a anula contractul si pentru a primi o rambursare in termen de paisprezece(14) zile de la incetarea contractului, pentru orice produs pe care l-ati platit, dar pe care nu l-ati primit.
Toate comenzile necesita o semnatura la livrare. In cazul in care nu sunteti acolo pentru a receptiona comanda, transportatorul va va lasa informatii de contact, o carte de livrare sau vava contacta pentru a efectua demersuri alternative.
In cazul in care, dupa o livrare esuata, dumneavoastra si transportatorul nu reprogramatilivrarea/colectarea intr-un termen rezonabil, atunci, fie transportatorul, fie PCD va va contactapentru instructiuni suplimentare si va poate percepe costuri de depozitare si orice alte costuride livrare. In cazul in care, in ciuda eforturilor rezonabile, nu reusim sa va contactam sau sareprogramam livrarea sau colectarea, putem anula contractul si puteti fi obligat sa ne platitidespagubiri.
4.2. Adresele de Livrare
Cu exceptia cazului in care ne spuneti altfel in timpul procesului de comanda, va vom livraprodusele achizitionate la adresa de livrare pe care ati furnizat-o in informatiile contuluidumneavoastra.
Vom depune toate eforturile rezonabile pentru a livra la adresa indicata. Cu toate acestea, nu vom fi raspunzatori pentru ne-livrarea sau livrarea eronata ca urmare a introducerii incorecte a datelor de catre dumneavoastra.
Ne pare rau ca livram comenzile online doar la adresele din Romania.
4.3 Responsabilitate si Proprietate
In momentul livrarii, trebuie sa verificati conformitatea comenzii cu
transportatorul si saformulati toate rezervele necesare, daca exista
(defecte aparente, colet deteriorat, colet deschisetc.) pe bonul de livrare
cat mai detaliat posibil si sa refuzati coletul. In acest caz, trebuie, de
asemenea, sa contactati in cel mai scurt timp Serviciul de Clienti si vom
lansa cercetarilecorespunzatoare.
Veti fi responsabil pentru produsele odata ce acestea au fost livrate la adresa pe care atifurnizat-o.
Sunteti proprietarul produselor dupa ce am primit plata integrala.
5. Drepturile dumneavoastra la final de contract
Aveti dreptul de a inceta contractul cu PCD si de a returna produsele, dar dreptuldumneavoastra de a inceta contractul va depinde de produsele pe care le-ati achizitionat, dacav-ati razgandit pur si simplu, daca exista ceva in neregula cu produsele pe care vi le-am furnizat, cum ne comportam si cand decideti sa incetati contractul.
Daca doriti sa incetati contractul din cauza a ceva ce PCD a facut sau v-a spus PCD ca vaface, consultati articolul 5.1.
Daca doriti sa va exercitati dreptul de retur, consultati articolul 5.2. Este posibil sa putetiobtine o rambursare daca va aflati in "perioada de reflectie" in conditiile indicate la articolul5.2.
In cazul in care ceea ce ati cumparat este defect sau descris gresit, este posibil sa aveti dreptullegal de a obtine repararea sau inlocuirea produsului sau de a va recupera o parte sau totibanii, a se vedea articolul 5.3.
5.1 Incetarea contractului din cauza a ceva ce PCD a facut sau urmeaza sa
faca
Daca incetati un contract din unul dintre motivele mentionate mai jos,
contractul va incetaimediat si va vom rambursa integral in termen de
paisprezece (14) zile de la incetareacontractului, pentru orice produse care
nu au fost furnizate. Motivele sunt urmatoarele:
5.2 Dreptul dumneavoastra de retur
In timp ce PCD spera ca sunteti incantat de comanda dumneavoastra, daca, din
orice motiv, nu sunteti pe deplin multumit sau daca va razganditi, in
calitate de consumator, aveti un dreptlegal de retur, dupa cum urmeaza:
Din motive de igiena si de protectie a sanatatii, nu aveti un drept de retur in ceea ce privesteprodusele in cazul in care orice sigiliu sau protectie similara de pe aceste produse a fost ruptsau falsificat.
De asemenea, nu va puteti exercita dreptul de retur atunci cand achizitionati produse:
5.3 In cazul in care exista o problema cu produsul
Va rugam sa ne anuntati imediat dupa livrare in cazul unor deteriorari sau al unor produsefurnizate incorect sau daca produsele enumerate pe avizul de expediere nu corespund cu celedin livrare, contactand Serviciul de Asistenta Clienti (a se vedea detaliile de contact de la articolul 1) cu detaliile comenzii dumneavoastra. Pentru a asigura o rezolvare rapida, varugam sa furnizati numarul comenzii si cutia, materialele de ambalare, toate articolele gratuite(de exemplu, cadou(rile) la cumparare, esantion(e)) si articolele deteriorate pentru a fi inspectate de catre transportator.
In mod specific, toate produsele furnizate de noi beneficiaza de garantia legala de conformitate si de garantia legala impotriva viciilor ascunse.
Garantia legala de conformitate
Articolele L217-3 - L217-20 din Codul francez al consumatorului reglementeaza garantialegala de conformitate. De asemenea, va informam cu privire la existenta garantiei legale de conformitate a bunurilor in tara dumneavoastra de resedinta. Va rugam sa gasiti mai jos, pentru informarea dumneavoastra, traducerea unora dintre articolele din Codul francez al consumatorului:
Articolul L217-3 din Codul francez al consumatorului: “Vanzatorul trebuie sa livrezebunuri conforme cu contractul si cu criteriile prevazute la articolul L. 217-5”.
Acesta este raspunzator pentru viciile de conformitate existente la momentul livrariibunului in sensul articolului L. 216-1, care apar in termen de doi ani de la data livrarii. (...)
Vanzatorul este, de asemenea, raspunzator, pe parcursul aceleiasi perioade de timp, pentru orice lipsa de conformitate care rezulta din pachet, din instructiunile de ambalare, de montaj sau din instalare, atunci cand aceasta din urma a fost facuta sub responsabilitatea sa prin contract sau a fost efectuata sub responsabilitatea sa, sau atuncicand instalarea incorecta, efectuata de catre consumator in conformitate cu prevederilecontractului, se datoreaza unor deficiente sau erori in instructiunile de instalare furnizatede catre vanzator.
Aceasta perioada de garantie se aplica fara a aduce atingere articolelor 2224 siurmatoarele din Codul civil francez. Termenul de prescriptie pentru actiuneaconsumatorului incepe sa curga din ziua in care consumatorul ia cunostinta de lipsa de conformitate.”
Articolul L217-4 din Codul francez al consumatorului: “Bunurile sunt conforme cu contractul daca indeplinesc urmatoarele criterii, daca este cazul
1° Acestea corespund descrierii, tipului, cantitatii si calitatii, in special in ceea ce privestefunctionalitatea, compatibilitatea, interoperabilitatea sau orice alta caracteristicaprevazuta in contract;
2° Acestea sunt potrivite pentru orice scop special dorit de consumator, adus la cunostintavanzatorului cel tarziu la momentul incheierii contractului si acceptat de acesta din urma;
3° Acestea se livreaza cu toate accesoriile si instructiunile de instalare care trebuiefurnizate in conformitate cu contractul;
4° Acestea se actualizeaza in conformitate cu contractul.
Articolul L217-5 din Codul francez al consumatorului:
“I. In mod suplimentar fata de criteriile de conformitate cu contractul, bunul este conform daca indeplineste urmatoarele criterii:
1° Este adecvat pentru utilizarea normala a bunurilor de acelasi tip, tinand seama, dacaeste cazul, de orice dispozitii ale legislatiei Uniunii Europene si ale legislatiei nationale, precum si de toate standardele tehnice sau, in absenta unor astfel de standarde tehnice, de codurile de conduita specifice aplicabile in sectorul in cauza;
2° Daca este cazul, acesta are calitatile pe care vanzatorul le-a prezentat consumatoruluisub forma unui exemplar sau a unui model, inainte de incheierea contractului;
3° Daca este cazul, elementele digitale pe care le contine sunt furnizate in cea mairecenta versiune disponibila la momentul incheierii contractului, cu exceptia cazului in care partile convin altfel;
4° Daca este cazul, este livrat cu toate accesoriile, inclusiv pachetul si instructiunile de instalare pe care consumatorul le poate astepta in mod legitim;
5° Daca este cazul, acesta este furnizat cu actualizarile pe care consumatorul le poateastepta in mod legitim, in conformitate cu dispozitiile articolului L. 217-19;
6° corespunde cantitatii, calitatii si altor caracteristici, inclusiv durabilitatea, functionalitatea, compatibilitatea si siguranta, la care consumatorul se poate astepta in mod legitim pentru bunuri de acelasi tip, tinand seama de natura bunurilor, precum si de declaratiile publice facute de vanzator, de orice persoana aflata in etapa anterioara a lantului de tranzactii sau de o persoana care actioneaza in numele acestora, inclusiv in publicitate sau pe eticheta produsului.
1° ca nu le cunostea si ca nu era in masura in mod legitim sa le cunoasca;
2° ca, la momentul incheierii contractului, declaratiile publice fusesera corectate intr-un mod comparabil cu declaratiile initiale; sau
3° ca declaratiile publice nu ar fi putut influenta decizia de a cumpara.
Articolul L217-7 din Codul francez al consumatorului: “Defectele de conformitate care apar in termen de douazeci si patru de luni de la momentul livrarii bunurilor, inclusiv a bunurilor cu elemente digitale, sunt, daca nu se dovedeste contrariul, prezumate a fi existatla momentul livrarii, cu exceptia cazului in care aceasta prezumtie este incompatibila cu natura bunurilor sau a defectului invocat..(…)”
Articolul L217-8 din Codul francez al consumatorului: “In caz de neconformitate, consumatorul are dreptul de a obtine repararea sau inlocuirea bunurilor sau, in caz contrar, reducerea pretului sau anularea contractului, in conformitate cu conditiile prevazute in prezenta subsectiune. (...) Dispozitiile prezentului capitol nu aduc atingere acordarii de daune-interese.”
Articolul L217-9 din Codul francez al consumatorului: “Consumatorul are dreptul de a solicita ca bunurile sa respecte criteriile stabilite in subsectiunea 1 din prezenta sectiune. Consumatorul va solicita vanzatorului sa aduca bunurile in conformitate, alegand intrereparare si inlocuire. In acest sens, consumatorul pune bunurile la dispozitia vanzatorului.”
Articolul L217-10 din Codul francez al consumatorului: “Bunurile vor fi aduse in conformitate intr-un termen rezonabil, care nu poate depasi treizeci de zile de la cerereaconsumatorului si fara inconveniente majore pentru consumator, tinand seama de natura bunurilor si de utilizarea prevazuta de catre consumator. Repararea sau inlocuirea bunuluineconform include, daca este necesar, indepartarea si returnarea bunului si instalareabunului reparat sau inlocuit de catre vanzator. Un decret precizeaza termenii si conditiile de punere in conformitate a bunurilor.”
Articolul L217-11 din Codul francez al consumatorului: “Bunurile sunt aduse in conformitate fara niciun cost pentru consumator. Consumatorul nu este obligat sa plateascapentru utilizarea normala a bunului inlocuit in perioada anterioara inlocuirii acestuia.”
Articolul L217-12 din Codul francez al consumatorului: “Vanzatorul poate sa nu procedeze conform alegerii efectuate de catre consumator in cazul in care conformareasolicitata este imposibila sau implica costuri disproportionate in ceea ce priveste, in special:
1° Valoarea pe care ar avea-o bunurile daca nu ar exista lipsa de conformitate;
2° semnificatia lipsei de conformitate; si
3° posibilitatea de a alege cealalta optiune fara inconveniente majore pentru consumator.
Vanzatorul poate refuza punerea in conformitate a bunurilor in cazul in care acest lucrueste imposibil sau ar implica costuri disproportionate, in special in ceea ce priveste 1° si2°.
In cazul in care aceste conditii nu sunt respectate, consumatorul poate, dupa o notificarede punere in intarziere, sa urmareasca executarea silita in natura a solutiei solicitate initial, in conformitate cu art. 1221 si urmatoarele din Codul civil.
Orice refuz al vanzatorului de a proceda conform alegerii consumatorului sau de a aducebunurile in conformitate trebuie sa fie motivat in scris sau pe un suport durabil.”
Articolul L217-13 din Codul francez al consumatorului: “Orice bun reparat in cadrulgarantiei legale de conformitate beneficiaza de o prelungire de sase luni a acestei garantii. In cazul in care consumatorul opteaza pentru repararea bunului, dar vanzatorul nu face acest lucru, inlocuirea bunului pentru a-l aduce in conformitate va da nastere unei noiperioade de garantie legala de conformitate pentru bunul inlocuit. Aceasta dispozitie se aplica din ziua in care bunurile de inlocuire sunt livrate consumatorului.”
Articolul L217-14 din Codul francez al consumatorului: “Consumatorul are dreptul la o reducere a pretului bunurilor sau la anularea contractului in urmatoarele cazuri:
1° In cazul in care vanzatorul refuza sa aduca bunurile in conformitate;
2° In cazul in care bunurile sunt puse in conformitate dupa o perioada de treizeci de zilede la cererea consumatorului sau in cazul in care aceasta ii provoaca acestuia un inconvenient major;
3° In cazul in care consumatorul suporta in mod definitiv costul de preluare sau de indepartare a bunurilor neconforme sau daca suporta instalarea bunurilor reparate sau de inlocuire sau costurile aferente;
4° In cazul in care neconformitatea bunurilor persista in ciuda incercarii vanzatorului de a le pune in conformitate, care nu a avut succes.
De asemenea, consumatorul are dreptul la o reducere a pretului bunurilor sau la anulareacontractului in cazul in care neconformitatea este atat de grava incat justifica reducereapretului sau anularea imediata a contractului. In acest caz, consumatorul nu este obligatsa ceara in prealabil repararea sau inlocuirea bunurilor.
Consumatorul nu are dreptul de a anula vanzarea in cazul in care neconformitatea esteminora, iar vanzatorului ii revine sarcina de a dovedi acest lucru. Prezentul alineat nu se aplica in cazul contractelor in care consumatorul nu plateste un pret.”
Articolul L217-15 din Codul francez al consumatorului: “In cazurile prevazute la articolulL. 217-14 din Codul francez al consumatorului, consumatorul informeaza vanzatorul cu privire la decizia sa de a obtine o reducere a pretului bunurilor. Reducerea pretului esteproportionala cu diferenta dintre valoarea bunului livrat si valoarea bunului in absentaneconformitatii.”
Articolul L217-16 din Codul francez al consumatorului: “In cazurile prevazute la articolulL. 217-14 din Codul francez al consumatorului, consumatorul trebuie sa informezevanzatorul cu privire la decizia sa de a anula contractul. Acesta returneaza bunurilevanzatorului pe cheltuiala acestuia din urma. Vanzatorul ramburseaza consumatoruluipretul platit si ii restituie orice alt beneficiu primit in cadrul contractului.”
Articolul L217-17 din Codul francez al consumatorului: “Rambursarea catre consumator a sumelor datorate de vanzator in temeiul prezentei subsectiuni se face la primirea bunurilorsau a dovezii de returnare a acestora de catre consumator si cel tarziu in urmatoarelepaisprezece zile. Vanzatorul ramburseaza aceste sume folosind acelasi mijloc de plata ca si cel utilizat de consumator la incheierea contractului, cu exceptia cazului in care acestadin urma este de acord in mod expres si, in orice caz, fara costuri suplimentare.”
In cadrul garantiei legale de conformitate si in masura permisa de lege, cu conditia ca (i) cererea dvs. sa indeplineasca conditiile de aplicare a garantiei si (ii) sa actionati in termen de doi (2) ani de la livrarea produsului, puteti obtine:
- repararea sau inlocuirea produsului cu un produs
identic (cu conditia ca un astfel de produs sa fie
disponibil in stoc), la alegerea dumneavoastra, cu
exceptia cazului in care una dintre aceste optiuni
implica un cost disproportionat pentru PCD in comparatie
cu cealalta optiune posibila, sau
- in cazul in care repararea si inlocuirea produsului nu
sunt posibile sau nu pot fi puse in aplicare in termen
de treizeci (30) de zile de la solicitarea dvs. sau va
provoaca un inconvenient major, o rambursare totala sau
partiala a pretului produsului, princreditarea contului
dvs. bancar, in termen de cel mult paisprezece (14) zile
de la primirea de catre PCD a produsului returnat.
Va rugam sa retineti ca (i) nu sunteti obligat sa dovediti existenta unui viciu de conformitatea produsului in cele douazeci si patru (24) de luni de la livrarea produsului si (ii) ca garantialegala de conformitate se aplica independent de orice garantie comerciala care ar fi putut fi acordata.. In cele din urma, va rugam sa retineti ca puteti decide sa puneti in aplicare garantia legalaimpotriva viciilor ascunse in conformitate cu caseta de mai jos. |
Garantie legala impotriva viciilor ascunse
Articolele 1641 - 1649 din Codul civil francez reglementeaza garantia legala impotrivaviciilor ascunse.
Va rugam sa gasiti mai jos, pentru informarea dumneavoastra, traducerea unora dintre acestearticole:
Articolul 1641 din Codul Civil francez: “Vanzatorul este tinut de garantie pentru viciileascunse ale bunului vandut, care il fac impropriu scopului pentru care a fost destinat saucare diminueaza atat de mult aceasta utilizare incat cumparatorul nu l-ar fi achizitionatsau ar fi dat doar un pret mai mic daca le-ar fi cunoscut.”
Articolul 1644 din Codul Civil francez: “In cazul articolelor 1641 si 1643 din Codul civil francez, cumparatorul are posibilitatea de a alege intre a restitui bunul si a i se restituipretul sau a pastra bunul si a i se restitui o parte din pret.”
Articolul 1646 din Codul Civil francez: “In cazul in care vanzatorul nu a avut cunostintade viciile lucrului, acesta este obligat doar la restituirea pretului si la rambursareacumparatorului pentru cheltuielile ocazionate de vanzare.”
Articolul 1648 din Codul Civil francez: “Actiunea rezultata din viciile ascunse trebuie safie introdusa de cumparator in termen de doi ani de la descoperirea viciului. (…)”
In cadrul garantiei legale a viciilor ascunse, atunci cand este cazul, cu conditia sa aducetidovada existentei viciului ascuns, puteti obtine:
- o rambursare a pretului produsului in cazul in care
returnati produsul, sau
- rambursarea unei parti din pretul produsului in cazul
in care pastrati produsul, cu exceptia oricarei
despagubiri, prin creditarea contului dvs. bancar, cel
tarziu in termen de paisprezece (14) zile de la
recunoasterea si acceptarea de catre PCD a
viciuluiascuns.

Daca doriti sa va exercitati drepturile legale in cazul unei neconformitati sau al unui viciuascuns al produselor, in conformitate cu garantiile legale relevante, va rugam sa contactatiServiciul de Asisitenta Clienti (a se vedea datele de contact de la articolul 1) care va vaindruma cu privire la modul de returnare a produselor si/sau de solicitare a unei reparatii, a unei inlocuiri sau a unei rambursari a produsului in cauza.
6. Cum sa efectuati o returnare
Sub rezerva articolului 6. b), in cazul in care aveti dreptul de a returna produsele in temeiularticolului 5, aveti dreptul de a returna produsele in cauza si articolele complementareasociate, daca exista [de exemplu, cadou(e) la cumparare, esantion(e)] , gratuit. Va rugam sacontactati Serviciul nostru pentru clienti folosind datele de contact de la articolul 1 pentru a neinforma cu privire la returnare. Serviciul nostru pentru clienti va va indruma, daca estenecesar, cu privire la modul in care trebuie sa returnati produsele si/sau sa solicitati o reparatie sau o inlocuire sau o rambursare a produsului in cauza.
Va rugam sa retineti ca, in cazul in care efectuati o returnare folosind o alta metoda decat ceapropusa de noi (de exemplu, eticheta de expediere preplatita), veti fi responsabil si vetisuporta integral toate costurile si taxele aplicabile implicate pentru returnarea produselor.
Va rugam sa va asigurati ca obtineti o dovada de expediere atunci cand ne returnati produselesi, daca este cazul, articolele complementare asociate (de exemplu, cadou(rile) la cumparare, mostra(e)). Ar trebui sa pastrati dovada de expediere pentru a ne oferi dovada ca ati returnatprodusele si toate articolele complementare (de exemplu, cadou(rile) la cumparare, mostra(e)), in cazul improbabil in care nu primim coletul returnat.
In pachetul de comanda, veti gasi un “Formularul de Retur” cu detalii despre comanda dvs., impreuna cu detalii despre procesul nostru de returnare.
a) Returnarea Produselor
Produsele si toate articolele gratuite (de exemplu, cadouri la cumparare, mostra(e)) trebuie sane fie returnate imediat la centrul nostru de distributie la adresa furnizata de Serviciul de Asistenta Clienti sau in "Formularul de Retur" din pachetul comenzii.
In orice caz, va rugam sa va asigurati ca pachetul returnat este sigilat corespunzator si caobtineti o dovada de expediere.
b) Procedura de returnare privind articolul 5.2 (dreptul de anulare)
Fara a aduce atingere celor de mai sus, in cazul in care aveti dreptul de a returna produsele in temeiul articolului 5.2, va rugam sa contactati Serviciul de Asistenta Clienti la numarul de telefon +40 216550959 intre orele 10.00-18.00 de luni pana vineri, cu exceptia sarbatorilorlegale din Franta, sau prin e-mail la contact@dior.com. Reprezentantii Serviciului de Asistenta Clienti va vor pune la dispozitie o eticheta de transport precompletata si preplatitape care sa o lipiti pe pachet si va vor instrui cu privire la modul de organizare a unei colectaricu DHL.
In acest scop, va rugam sa atasati:
Adresa de retur trebuie sa figureze pe orice eticheta de transport preplatita dupa cum urmeaza: Customer Returns Service Dior.com, 185 Avenue de Verdun 45804 Saint Jean de BrayeCedex, Franta.
Va rugam sa retineti ca:
c) Procesarea rambursarii, inlocuirii sau reparatiei
i) In cazul in care ati returnat produsele pentru ca v-ati exercitat dreptul de anulare, vomprocesa rambursarea calculata, utilizand metoda de plata initiala, cat mai curand posibil si, in orice caz, in termen de paisprezece (14) zile de la data la care primim produsele returnate sau(daca este mai devreme) de la data la care ne furnizati dovada ca ne-ati trimis produseleinapoi la centrul nostru de distributie. Nu vom fi obligati sa efectuam o rambursare daca nu ne puteti furniza dovada ca ati trimis produsele si toate articolele gratuite (de exemplu, cadou(e) la cumparare, esantion(e)) inapoi la noi, prin urmare, va rugam sa va asigurati ca pastrati sisunteti in masura sa furnizati dovada de expediere. Va rugam sa retineti ca nu se va oferi o rambursare integrala pentru produsele returnate care prezinta semne de utilizare nejustificata.
ii) Daca ati returnat produsele pentru ca sunt deteriorate sau in cazul unei neconformitati saual unui defect in conformitate cu garantia legala relevanta si daca ne-ati solicitat sa varambursam partial sau integral produsele, vom procesa rambursarea cat mai curand posibil si, in orice caz, in termen de paisprezece (14) zile de la data la care primim produsele returnate sidaca va confirmam ca aveti dreptul la o rambursare.
Rambursarea se va face numai pe cardul de credit/debit original utilizat pentru achizitie. Vetiprimi o notificare prin e-mail cu privire la rambursare din partea Serviciului de AsistentaClienti.
iii) In cazul in care ati returnat produsele pentru ca sunt deteriorate sau in cazul uneineconformitati sau al unui defect in conformitate cu garantia legala relevanta si daca ne-atisolicitat sa reparam sau sa inlocuim produsele, va rugam sa retineti ca vom proceda la repararea sau inlocuirea acestora daca confirmam ca aveti dreptul la aceasta si cu conditia ca optiunea aleasa de dumneavoastra sa nu fie imposibila sau disproportionata, asa cum estestabilita de legea aplicabila. Orice refuz de a proceda conform alegerii dumneavoastra sau de a aduce produsul in conformitate va fi motivat in scris sau pe un suport durabil de catreServiciul de Asistenta Clienti. In cazul in care ati solicitat o inlocuire si daca am acceptat-o, aceasta va fi procesata in termen de paisprezece (14) zile lucratoare de la primirea produselorreturnate si va fi livrata prin livrare standard. Livrarile de produse de inlocuire vor fi finalizatein conditiile de livrare stabilite mai sus.
7. Raspunderea noastra fata de dumneavoastra
In cazul in care nu respectam acesti Termeni sau nu folosim o indemanare si o atentierezonabila in legatura cu evenimentele pe care le organizam cu dumneavoastra, suntemraspunzatori fata de dumneavoastra pentru pierderile si daunele directe previzibile care vasunt cauzate ca urmare. Pierderea sau daunele sunt previzibile daca este de neuitat ca se vorintampla sau daca, la momentul incheierii contractului intre noi, atat PCD cat sidumneavoastra stiam ca se pot intampla.
Va furnizam produsele doar pentru uz privat si nu in scopuri comerciale, de afaceri sau de revanzare. Prin urmare, nu vom avea nicio raspundere fata de dumneavoastra pentru oricepierdere de profit, pierdere comerciala, intrerupere de activitate sau pierdere comerciala de oportunitate.
8. Datele cu caracter personal colectate
Va rugam sa consultati Politica noastra de Protectie a Datelor cu Caracter
Personalaccesibila aici pe Website pentru a
intelege cum vom utiliza, procesa si proteja informatiile personale si
datele transmise de dumneavoastra atunci cand vacreati un cont, cumparati
produse si atunci cand utilizati in alt mod Website-ul.
Vom utiliza datele, inclusiv informatiile personale pe care ni le furnizati:
(a) pentru a va furniza produsele;
(b) pentru a procesa plata dumneavoastra pentru produse; si
(c) daca sunteti de acord cu acest lucru in timpul procesului de comanda, pentru a va informacu privire la produse similare pe care le oferim, dar puteti inceta sa mai primiti acesteinformatii in orice moment, contactandu-ne.
Vom furniza informatiile dumneavoastra personale unor terte parti numai in conditiile stabilitein Politica noastra de Protectie a Datelor cu Caracter Personal.
9. Proprietatea Intelectuala
Toate drepturile de proprietate intelectuala, indiferent de natura lor, atasate tuturor produselorvandute pe website si elementelor care apar pe website (inclusiv, in special: texte, logo-uri, marci comerciale, grafica, imagini, fotografii, fotografii, videoclipuri, animatii, nume si oricealt element) sunt si raman proprietatea exclusiva a PCD si ii sunt rezervate in mod exclusiv. In aceste conditii, nimeni nu este autorizat sa reproduca, sa reprezinte, sa exploateze, saadapteze, sa difuzeze sau sa utilizeze, prin orice procedeu, in orice scop, partial sau integral, drepturile de proprietate intelectuala asupra produselor vandute pe website si asupraelementelor care apar pe website, fara acordul prealabil scris al PCD.
10. Alti Termeni Importanti
Putem transfera drepturile si obligatiile noastre in temeiul acestor Termeni catre o altapersoana sau organizatie. Va vom anunta in scris daca se intampla acest lucru si ne vomasigura ca transferul nu va afecta drepturile dumneavoastra in temeiul contractului.
Puteti transfera drepturile sau obligatiile dumneavoastra in temeiul acestor Termeni catre o alta persoana numai daca suntem de acord in scris cu acest lucru. Nu vom refuza sau intarziain mod nejustificat consimtamantul nostru.
Acest contract este incheiat intre dumneavoastra si noi. Nicio alta persoana nu va avea dreptulde a pune in aplicare oricare dintre Termenii sai.
Fiecare dintre paragrafele din acesti Termeni functioneaza separat. In cazul
in care o instantasau o autoritate competenta decide ca oricare dintre ele
este ilegala sau inaplicabila, celelalteparagrafe vor ramane in vigoare.
Daca nu insistam imediat sa faceti ceea ce vi se cere sa faceti in
conformitate cu acestiTermeni, sau daca intarziem sa luam masuri impotriva
dumneavoastra in ceea ce privesteincalcarea acestui contract, acest lucru nu
va insemna o renuntare la drepturile noastre sau canu trebuie sa faceti
acele lucruri si nu ne va impiedica sa luam masuri impotrivadumneavoastra la
o data ulterioara.
Termenii reglementati sunt guvernati de legea Franceza, sub rezerva normelor obligatorii din tara dumneavoastra de resedinta si puteti introduce o actiune in justitie cu privire la produse in instantele Franceze, sub rezerva normelor obligatorii din tara dumneavoastra de resedinta, sauputeti solutiona litigiul prin intermediul unui mecanism alternativ de solutionare a litigiilor, astfel cum se prevede mai jos.
Informatii privind solutionarea alternativa a litigiilor: Comisia Europeana ofera posibilitateade solutionare online a litigiilor pe o platforma online administrata de aceasta. Aceastaplatforma poate fi accesata prin intermediul linkului externhttp://ec.europa.eu/consumers/odr/. Nu suntem obligati sa participam la o procedura de conciliere si, din pacate, nu putem oferi participarea la o astfel de procedura.
ANEXA 1 – FORMULARUL DE RETUR |
REAMINTIREA PROCEDURII DE RETURNARE
In cadrul exercitarii dreptului dumneavoastra de anulare:
Pentru a va organiza returul, va rugam sa contactati Serviciul de Asistenta Clienti la numarul de telefon +40 216550959 de luni pana vineri intre orele 10.00 si 18.00 sau prin e-mail la contact@dior.com. ReprezentantiiServiciului de Asistenta Clienti va vor furniza o eticheta de transport precompletata si preplatita pe care sa o lipiti pe pachet si va vor instrui cu privire la modul de organizare a unei colectari cu DHL.
In acest scop, produsele in cauza trebuie, de asemenea, sa fie insotite de Formularul de Retur completat prevazutin Anexa 1 la sectiunea Termeni si conditii de vanzare de pe www.dior.com sau de orice alta declaratie scrisafara echivoc prin care va exprimati decizia de a va exercita dreptul de anulare cu eticheta DHL.

Va rugam sa retineti ca toate retururile trebuie sa fie expediate folosind cutia exterioara originala.
Din motive de igiena si de protectie a sanatatii, nu aveti un drept de anulare in ceea ce priveste produsele in cazul in care orice sigiliu sau protectie similara de pe aceste produse a fost rupt sau falsificat.
In plus, va informam ca nu va veti putea exercita dreptul de anulare atunci cand achizitionati produse:
Parfums Christian Dior va emite rambursarea prin utilizarea metodei initiale de plata cat mai curand posibil sau, in orice caz, in termen de paisprezece (14) zile de la sosirea produselor returnate sau de la livrarea dovezii de expediere a produselor, data aleasa fiind cea a primului dintre aceste fapte, in conformitate cu legislatiaaplicabila.
Nu suntem obligati sa rambursam niciun cost de livrare suplimentar daca alegeti o alta metoda de livrare decateticheta DHL furnizata de noi.
Alte motive de intoarcere? In cazul unui defect al produsului, va rugam sa contactati Serviciul de AsistentaClienti la numarul de telefon +40 216550959 , de luni pana vineri, intre orele 10.00 si 18.00, sau prin e-mail la contact@dior.com .
Va reamintim ca conditiile de retur in integralitatea lor sunt mentionate in sectiunea Termeni si conditii generalede vanzare de pe www.dior.com .
*In cazul in care a 30-a zi este sambata, duminica sau sarbatoare legala, termenul se prelungeste pana in prima zi lucratoare.
